Branding & brand management: the legal aspects

Your house style is the key element of your company’s image and the message you want to convey. This applies for both online and offline communication. Are you working on your company’s branding? Dirkzwager is providing a free seminar on 28 October 2014 at which we will be discussing the key legal aspects of branding & brand management.

Name and logo
Protecting your name and logo is essential in order to make a return on your costly marketing efforts. Registering brand names and logos requires a good strategy. Not only will you have to clearly delineate the products for which you are claiming protection, you must also make the right choice for the filing of your colour logos. We will discuss the most recent legislation and case law relating to branding and give concrete tips on registering trademarks, social media accounts and domain names. We will also talk about the scope of protection enjoyed by trademarks on the internet and beyond.

Visual material
The look and feel of your new website, app or social media accounts represent your company’s image. The visual material you use for this branding is often copyright-protected. This could include the design of your house style, photographic material and illustrations. Good – written – agreements are needed if you engage a photographer or designer (advertising agency) to improve your branding, to ensure that you hold the rights to these materials. We explain what possibilities the Copyright Act provides in this regard. We will also talk about the protection of video material.

Advertising
Finally, we will discuss the legal possibilities and impossibilities of advertising. Perhaps you would like to compare yourself to others or others have been comparing themselves to you, but when is that permitted? And where is the line between fully informing the public about products on the one hand and misleading it on the other? A legal policy for the contents of advertising by you and by others is very important for positive (or negative) public perception. We will discuss the Comparative and Misleading Advertising and Unfair Commercial Practices Act and the doctrine of lawful and unlawful latching on to a house style.

Interactive seminar
There will be plenty of time to ask questions during the seminar. There will also be an opportunity to share your own experiences and/or your views on certain issues.

This seminar on branding is intended for all businesses that deal with branding and house style protection in practice. Using concrete practical examples, we will bring you up to speed on the legal aspects of branding and brand management.
